SAMWU to Challenge Msukalinga Local Municipality Illegal Dismissals

The Municipal Workers Union is total disturbed and against the dismissal of over two hundred workers by Muskaligwa local municipality in Mpumalanga Province. We condemn this harsh, unfair, unjust and illegal action taken by the employer. This is an action that was not even precessed by any disciplinary processes contrary to the country’s labour laws.

SAMWU members in the municipality embarked on a protest action following the municipality’s failure to pay third parties including members’ monthly subscriptions to the union Head Office. In addition to this demand, workers also demanded that the municipality provides them with Personal Protective Equipment so to allow them to fully do their jobs which the municipality has for a long time failed to provide to workers.

In response to legitimate demands by workers and acting in bad faith and not negotiating with the workers with the view of finding common ground by resolving these issues, municipal management decided that they will compromise service delivery in the area by dismissing over 200 workers.

We are of the view that the actions of the workers were premeditated and are uncalled for as this is not the way to deal with issues affecting workers. We are convinced that the municipal management took this decision with the sole intention of silencing workers and that of liquidating the union in the municipality for fear of a robust and militant union.

The municipality has on numerous occasions deliberately failed to convene local labour forum meetings thus meaning that there would be no platform for engagement between organised labour and the employer, going further as forcefully removing elected shop stewards from their allocated offices and unilaterally banning circulation of any document that has SAMWU logo on it.

This and other actions by the municipality have been deliberate attempts by municipal management to ensure that collective bargaining in the municipality collapses. We therefore call on the immediate and unconditional reinstatement of all workers otherwise we will be left with no choice by meeting the employer in court, including the streets.
