Ekurhuleni Municipality intends to pass illegal resolution SAMWU PRESS STATEMENT 23 June 2010.
We have learnt that the Ekurhuleni Municipality intends to pass an absurd resolution on the 24 June 2010, which seeks to stop members of SAMWU from becoming shop stewards. As SAMWU we view the decision to be against the constitutional right of citizens of the country, against the Labor Relations Act & the organizational rights agreement concluded in the South African Local Government Bargaining Council.
If the Ekurhuleni Municipality passes the resolution, it will also be against the court ruling that allowed all employees to participate in union activities and be elected in positions. No resolution by the Municipality can contradict the legislation, collective agreements and court judgment. The resolution will be illegal because it has no legal basis for existence. The Ekurhuleni Municipality cannot expect to be treated any different, as compared to other municipalities in the country, in terms of union involvement. As the largest Local Government Union, we have lodged a grievance against the Municipality, with regards to the intended resolution. Senior officials that are advising the municipality should be disciplined, for misleading the Municipality on the proposed resolution, which is supposed to be adopted on the 24 June 2010. Lastly if this absurd resolution is passed, it will also be against the constitution of the Union. The Municipality must come out and indicate what do they plan to achieve with such a resolution and they must also indicate who they are targeting with the intended resolution.
