Statement on the charging of shop stewards and outsourcing of functions of the Ekurhuleni Municipality SAMWU PRESS STATEMENT 14 June 2010.
The Ekurhuleni municipality intends to waste more money on lawyers to handle disciplinary cases just before 01 July 2010, when the new collective agreement comes into effect. We view this as an attempt to undermine the disciplinary collective agreement concluded on 21 April 2010. They are currently consolidating all cases so that these cases be part-heard by private lawyers, the municipality wants to continue to spend more money on lawyers, even after 01 July 2010. We are calling upon the Ekurhuleni municipality to walk the talk because in the budget speech the Mayor spoke about cutting costs and tightening the financers but this approach of giving cases to lawyer’s, means that they are adamant about wasting rate payer’s money.
We have also observed that the municipality is in the process of charging all shop stewards in Ekurhuleni because shop stewards spoke out on the following; • Wasteful & fruitless expenditure of Public funds by senior officials • Building of internal capacity of employees to improve service delivery • Strengthening of relations between organized labour and the employer • Demanding of a report that was compiled by the Task Team of six from Provincial Government (led by Pascal Moloi and Mosley Lefatola) It is very interesting to observe that the Ekurhuleni municipality has a huge interest in people sweet talking them into stealing money from the budget. The municipality intends to charge all shop stewards during the FIFA Soccer World Cup. We believe that they have been praying that the shop stewards disappear during the FIFA Soccer World Cup, so that shop stewards will disappear “unnoticed”. The charging of all shop stewards will mean that the municipality intends to fight 70% of the employees and the community because shop stewards were given a mandate by SAMWU members to raise the above issues without fear or favour. It should also be noted that if the municipality continues with their intentions to charge shop stewards without engaging SAMWU, on issues raised, then they will have to deal with all members in the municipality when the case starts. Members have confirmed that one shop steward will have more than 10 000 witnesses in the box, during the hearing but even if shop stewards are charged/dismissed the issues will not disappear.
